McBeath was arrested Dec. 9 at 1604 Oakridge Ave. in Dayton and transported to Dayton’s federal building.
“While being processed, McBeath admitted to detectives and deputy marshals that he was concealing narcotics in his buttocks,” the report said. A baggie from McBeath’s buttocks included heroin, cocaine and crack. McBeath also had $793 that was seized.
On Dec. 11, Dayton police arrested Spiva at 104 Central Ave. in Dayton. Spiva had cocaine in a baggie concealed in his buttocks, according to the report. Officers took $100 from Spiva’s pockets.

Both have trials scheduled for Feb. 8 in front of U.S. District Judge Thomas Rose. There is a Feb. 3 hearing on a motion from Spiva’s attorney to withdraw.
In it, Spiva’s attorney wrote that Spiva said he “wasn’t working hard enough” and that the attorney-client relationship was “irretrievably broken.”
