He received credit for 259 days already spent in jail, and at the time of writing was in the Montgomery County Jail.
Whitaker was charged along with William Lamont Brown Jr., 19, in the Jan. 12, 2024 death of Isaiah Murray, 20.
The shooting was reported at 12:25 p.m. at the rec center at 2100 W. Third St.
The report led to the center and nearby Roosevelt Elementary School to go on lockdown as police searched for the suspects.
Whitaker was accused of displaying a firearm during a robbery of three men, according to an affidavit filed in Dayton Municipal Court.
“Mr. Whitaker conspired with several other people to set up and complete the robbery. During the robbery, Isaiah Murray was shot and killed as a proximate result,” the affidavit said.
Dayton Police Maj. Brian Johns said previously that many shots were fired, and one round hit a window at the rec center.
A 911 caller who said he was pulling into the parking lot when he heard gunshots said, “Somebody definitely got shot. It looked like the guy shot him, he went down and then the guy shot him again.”
An autopsy later determined that Murray died from a gunshot wound to the head.
Brown was indicted on one count of murder and three counts of complicity to commit aggravated robbery, according to Montgomery County Common Pleas Court records.
He is currently in the Montgomery County Jail, and is scheduled for trial on March 10.
