Brinegar, who lived in Dayton at the time of the offense in June 2023, previously pleaded guilty May 13 but Jackson allowed her to withdraw her plea the following month.
A 16-year-old girl said her mother had been taking images of her and selling them to men because she was a juvenile and they would make more money, according to an affidavit filed in Dayton Municipal Court.
“(The woman) was interviewed and denied selling her images, but admitted to selling her own images,” the document stated.
Following her original plea, her attorney argued that she was a prime candidate for probation because was a married mother of three with a full-time job who also has health issues following a cancer diagnosis.
“Had this matter went to trial, the defense believes the evidence would show that Ms. Brinegar sent one photo of her daughter that showed the upper half of her body, with some obstructions,” a sentencing memorandum filed June 16 stated.
Brinegar was ordered to not have contact with her child and was designated a Tier II sex offender, which will require her to register her address with her local sheriff’s office every six months for 25 years.
