Dayton man charged with murder in July deadly shooting

A Dayton man is facing murder and other charges in the July deadly shooting of a man in front of an Arby’s.

David Martez Brown, 42, is scheduled to be arraigned Tuesday in Dayton Municipal Court for four counts of murder, two counts of felonious assault, two counts of aggravated robbery and one count of having weapons while under disability after charges were filed Monday afternoon.

The gunshot victim was identified as 33-year-old Mo’rrell M. Fontenot by the Montgomery County Coroner’s Office. He is survived by his daughter, mother, five siblings and other family and friends, according to his obituary.

Dayton police were dispatched around 12:30 a.m. July 28 to 2828 Salem Ave. on a report of a shooting.

“(Fontenot) was walking on the sidewalk in front of Arby’s restaurant, and he was approached by another male,” said Dayton police Maj. Brian Johns. “That male then shot him several times and fled the scene.”

The shooting happened during a robbery, according to an affidavit.

The shooter, later identified as Brown, reportedly fled the scene on foot.

A warrant was issued Monday afternoon for Brown’s arrest.
