Dayton sex offender faces child sexual abuse material charges for third time

A Dayton man who is a convicted sexual offender is facing charges for a third time related to child sexual abuse material.

David Christopher Miller, 57, was indicted Monday in Montgomery County Common Pleas Court on a dozen charges of illegal use of a minor in nudity-oriented material or performance, all felonies.

Miller is scheduled to be arraigned on Jan. 14.

According to the Montgomery County Prosecutor’s Office, Dayton police began to investigate Miller after a referral from the Internet Crimes Against Children Task Force. The task force said that they believed he had been downloading child sexual abuse material, and police said they found the material on Miller’s cellphone and tablet.

According to the prosecutor’s office, when the material was found Miller was out on parole for similar activity in 2019. He was arrested on a parole violation, and according to Ohio Department of Rehabilitation and Correction records is currently booked in the Lorain Correctional Institution.

Miller is a Tier III sex offender, meaning he must register his address with the sheriff’s officer every 90 days for the rest of his life.

He was convicted in May 2011 of multiple counts of pandering sexually-oriented matter involving a minor and sentenced to 12 months in prison for each count to be served concurrently, though he was released about halfway through his sentence.

Miller also pleaded guilty in 2020 on charges including pandering obscenity involving a minor, pandering sexually-oriented matter involving a minor and illegal use of a minor in nudity-oriented material. He was sentenced to a total of 30 months in prison for the charges and found a Tier III sex offender.
