Mosley was accused of shooting once from the front porch of his residence in the 11000 block of Friend Road at two people as they sat inside a vehicle, according to an affidavit filed in Miamisburg Municipal Court.
In two sentencing memorandums, though, the prosecutor’s office said that the two men in the vehicle said Mosley shot into the air, and an attorney for Mosley said the shot was fired into the ground.
The pair left but Mosely followed in his vehicle, at one point passing their vehicle and stopping in front of them, blocking the road on Germantown Middletown Road, the affidavit said.
Mosley was accused of then firing up to four more shots from a handgun the affidavit said.
The affidavit said the shots were fired at the pair; however, again the prosecutor’s office sentencing memorandum said that the men claimed Mosley fired the gun into the air, and Mosley’s attorney said the shots were fired into the ground.
German Twp. police said that Mosley admitted to the incident.
No injuries were reported.
Mosley was charged with felonious assault along with the discharging a firearm charge, each with a three-year firearm specification that would have added time at sentencing if he were convicted, but the assault charge and the firearm specifications were dismissed as part of a plea agreement.
