Kettering standoff suspect indicted for firing gun in apartment, trespassing

A 46-year-old Dayton man indicted Friday is accused of trespassing in an Aberdeen Avenue apartment in Kettering when he was involved in a more than four-hour standoff with police.

Shawn Michael McNary is scheduled to be arraigned Tuesday in Montgomery County Common Pleas Court for improperly discharging a firearm at or into a habitation, which carries a three-year firearm specification; having weapons under disability for a prior offense of violence; trespass in a habitation; and two misdemeanor charges of inducing panic and aggravated menacing.

Officers responded around 8:30 p.m. Nov. 1 to an apartment building in the 500 block of Aberdeen Avenue after a resident told a 911 dispatcher he heard gunfire and that when he went downstairs to check it out, another man pointed a gun at him. The caller said he ran back upstairs and that once inside his apartment, he heard more gunfire, according to dispatch records.

Police evacuated multiple apartment buildings as a precaution, and tactical teams from Kettering and Beavercreek police departments also responded.

McNary finally left the apartment around 1 a.m. Nov. 2 and was taken into custody. He remains held in the Montgomery County Jail. He also is accused of a parole violation, jail records show.

Inside the apartment, police found multiple 40mm casings and bullet holes in the ceiling and walls.

“McNary advised officers that he shot at the walls because he thought that people were trying to enter the apartment through them,” according to an affidavit filed in Kettering Municipal Court.
