Man pleads guilty to arson for two fires set within hours at same Dayton house

A Dayton man accused of setting two fires inside the same house within three hours has pleaded guilty to a bill of information as part of a plea deal.

Kevin S. Carter Jr., 43, pleaded guilty Thursday to one felony count of arson in Montgomery County Common Pleas Court. According to the plea agreement, he could face between six and 18 months in prison and fines of up to $5,000. He could then be sentenced to up to five years of probation.

Carter was also found to be an arson offender, and will have to register with the local sheriff’s office yearly for the rest of his life.

As part of the agreement, two indicted charges of aggravated arson and one of aggravated menacing have been dismissed.

He is scheduled to be sentenced Sept. 5.

The charges stem from July 13, when the Dayton Fire Department responded twice to a duplex in the 200 block of Xenia Avenue, first at 3:46 p.m. then again at 5:56 p.m. for separate fires in the house, according to Dayton Fire Capt. Brad French.

French said that firefighters remained on scene for an hour and a half after the first call and an hour and 20 minutes after the second call.

Both fires were inside the two-story home, and investigators determined they were set intentionally. No injuries were reported as a result of either fire, French said.

A criminal complaint filed in Dayton Municipal Court alleged that Carter “did by means of fire or explosion, knowingly cause physical harm to an occupied structure.”

Carter was arrested outside the scene of the fires, French said. He lives on Xenia Avenue a block away from the home that was set on fire.
