Christopher Daniel Dewey, 33, of Harrison Twp., and Jacob Michael Bartellis, 24, of Kettering, are facing one count of felonious assault in Montgomery County Common Pleas Court.
They are scheduled to be arraigned on Jan. 7.
Around 2:45 a.m. on May 5, Miami Twp. police responded to a fight in the 2300 block of Owendale Drive.
Dewey told an officer he was drunk and lying in the driveway while his girlfriend was trying to get him inside when a vehicle pulled and people “were acting crazy,” according to municipal court records.
A passenger in the vehicle reported the vehicle had been hit and they were following the other vehicle for insurance information.
“When the vehicle stopped, he got out and two males approached him,” an affidavit read. “They males punched him in the face and tackled him.”
The men who hit him reportedly matched the description of Bartellis and Dewey.
A woman who was in the vehicle was allegedly pushed to the ground when she tried to take a picture of the other vehicle’s license plate.
Bartellis and Dewey punched a man in the face, causing him to fall and hit his head on the concrete, according to court records.
They reportedly kicked him while he was on the ground and would sweep his legs if he tried to stand.
The man had a bruise on the side of his face and a cut on his head. Two days later, he went to the hospital for head pain and was admitted to Miami Valley Hospital’s intensive care unit for a brain bleed and skull fracture, according to the affidavit.
