The charges stem from an incident on March 17.
According to documents from the Fairborn Municipal Court, Fairborn Police found the victim, who has not been identified publicly, lying in the parking lot of Sugar Mellon’s Club, located at 330 E. Dayton Dr., on March 17. Court documents say that Allen was attempting to calm down the victim, who was yelling and irate outside of the club. Without warning or apparent provocation, according to police, Allen punched the victim, who fell back and hit his head.
The police received video from the Sugar Mellon’s Club, which they reviewed.
Allen later told police he was not drinking at the time of the incident, nor did the man he allegedly hit make any aggressive movements toward him.
Allen was previously charged with felonious assault on March 18 in Fairborn Municipal Court. The case was dismissed after he was indicted by a grand jury for the same offense in April. The murder and involuntary manslaughter charges have since been added.
Fairborn police arrested Allen on Wallaby Drive in Beavercreek Monday night, according to Miami Valley Jail records.
