The older victim, who was 14 when Christopher J. Adkins, 32, assaulted her, said she wakes up in the night, frightened. “I’ll see a shadow and have to check my family,” the girl told Judge Wolaver.
Adkins was given 10 years in prison, the most allowed by law, for the two counts of unlawful sexual contact with a minor. He will have to register as a sex offender for 25 years.
Assistant Prosecutor Nicole Burke said rape charges were considered, but they wanted to spare the victims from having to testify in open court.
Adkins is the son of Dayton attorney Dennis Adkins, who serves as a part-time municipal prosecutor in Beavercreek and Oakwood and as an acting judge in Kettering. He lost a race to become a Montgomery County Common Pleas judge in 2008 by a narrow margin. He did not immediately return a call to his law office seeking comment.
The younger Adkins was never indicted for the sex crimes, Burke said. Prosecutors and police were in contact with Adkins and his attorney Steven Pierson after the crimes were committed in Fairborn and Beavercreek last year, she said. Adkins pleaded guilty in July and was free on bond up until his sentencing.
Judge Wolaver alluded to Adkins criminal history and psychological difficulties before imposing his sentence. “This is the first real time you have ever received real consequences for your behavior,” he said.
Wolaver noted how strongly Pierson “advocated” for Adkins, trying to minimize his jail term. He added that Adkins was a criminal justice student. “To say you should have known better is an understatement,” Wolaver said.
