Gumenik will have a detention hearing Wednesday afternoon to determine if he will remain behind bars during his prosecution. Gumenik had not been incarcerated before Monday, but had been issued an order to appear.
Federal public defender Art Mullins argued against Gumenik’s detention before the hearing, pointing out that his client appeared voluntarily on Monday.
Argument on the topic took place outside of the courtroom of U.S. District Court Magistrate Judge Michael Newman. After the judge and the attorneys re-entered the courtroom., Newman moved up the hearing from Thursday to Wednesday afternoon.
If convicted, Gumenik faces maximums of 15 years in prison, a $250,000 fine and from five years to life on supervised release. Gumenik was booked into Montgomery County Jail at 4:29 p.m. Monday.
Gumenik is not an active Air Force member nor is he a contractor that works on the base, according to Daryl Mayer, a spokesman at Wright-Patterson AFB.
The alleged crime took place in one of the two areas — The Prairies and The Woods — that are managed privately by The Properties at Wright Field. Gumenik has been evicted from the property. The federal government has jurisdiction over crimes in those locations.
According to social media posts under Aaron Gumenik’s name, he is married, studies integrated media at Cedarville University and volunteers at Destiny Church in Huber Heights.
