A man who surrendered to Dayton police after an overnight SWAT standoff is accused of shooting at his neighbors who had been setting off fireworks earlier in the evening.

Jason Michael Toscano, 37, was arrested at 7 a.m. Monday after he came out of his apartment in the 50 block of Parnell Avenue in Dayton.

Toscano is accused of firing one round just after midnight at three men as they left the back of a neighboring home in the 100 block of Livingston Avenue. No one was injured, and no property was damaged, according to an affidavit and statement of facts filed Tuesday in Dayton Municipal Court.

Police found one spent .45 casing.

The three men said they previously were in a dispute with Toscano, who they said was angry because they were setting off fireworks in their backyard.

Toscano is in the Montgomery County Jail  on suspicion of three counts of felonious assault and a misdemeanor firearm charge. He denied firing a round at the men, the affidavit stated.

He is scheduled to appear Wednesday in court.
