A Dayton man convicted of leaving another Dayton man, who was later pronounced dead, at the entrance to a hospital was sentenced Tuesday to 18 months in prison.

The sentencing judge called the situation “very sad.”

Virgil Corbin, 49, was indicted last year for a January 2017 incident in which Terry E. Sims, 59, was found at the Upper Valley Medical Center entrance by a nurse going to the hospital. The death was caused by multiple drug intoxication by fentanyl analog, cocaine, ethanol and hydrocodone, according to an autopsy report by Miami County Coroner William Ginn.

Corbin was charged with felony tampering with evidence and pleaded guilty in May in county Common Pleas Court.

Corbin asked to apologize to Sims’ family and friends as well as his own family and friends. He said he had suffered through many sleepless nights thinking about what he could have done.

“I only wish I could turn back the hands of time and do the exact opposite that morning,” Corbin said.

“This is a sad situation, a very sad situation,” Common Pleas Judge Jeannine Pratt told Corbin. “His acts got him (Sims) to the point he was unresponsive … Your actions after were criminal in nature. You didn’t call 911, didn’t take a more active approach.”

Pratt said she took into consideration as mitigating factors Corbin’s military service and a PTSD condition noted by professionals along with the victim contributing to his death.

She said a history of drug abuse by Corbin and a lengthy criminal record that included five previous prison terms contributed to the prison sentence.

Corbin will receive credit for 130 days served in the county jail.
