Confusion over the filing deadline for candidates seeking Miamisburg municipal seats and that city’s charter will negate a primary election there this spring.

The Montgomery County Board of Elections communicated the wrong filing deadline date, and the Miamisburg City Charter requires candidates from at least two parties in order to hold a primary, records show.

The Miamisburg city charter also states that candidates for mayor or city council must file valid petitions by 4 p.m. “of the ninetieth day before the day of such primary election,” and that election would have been in May.

The board of elections had posted on its website the filing deadline for independent candidates was May 6 instead of early February. Independent Brian Yeakley pulled petitions for a council seat, but as of late February had not filed them, board of elections records show.

Only Republican candidates Ryan Colvin, Jeff Nestor, Alyse Rettich and Greg Thompson filed by Feb. 6 for the three seats on this fall’s ballot, records show.
