“Deputies were dispatched on a suspicious vehicle call,” the prosecutor’s office said. “When the vehicle was located on Ontario Avenue, the deceased was in the back seat of the vehicle. Deputies issued commands for the deceased to exit the vehicle.”
Deputies commanded Brown to exit the vehicle, but instead he went to the front seat and drove the vehicle at one of the deputies, according to the Montgomery County Prosecutor’s Office.
“The deputy discharged his duty weapon one time, killing the suspect,” the prosecutor’s office said in a release.
The deputy was not identified by name in a press release from the Montgomery County Prosecutor’s Office, only referred to as John Doe. The sheriff’s office at the time of the incident told the Dayton Daily News that deputies involved were transported to Miami Valley Hospital for treatment and evaluation after the shooting.
A resident who lived near the shooting told the Dayton Daily News the next day that officers worked quickly to try to help the man after the shooting. She said she saw the deputies start CPR and tried to keep the man alive.
A special assistant prosecuting attorney from outside Montgomery County handled the cases and presented it to the grand jury. After reviewing the testimony and evidence, the grand jury declined to indict, the prosecutor’s office said, finding that the deputy acted lawfully.
