Judge Pleads Not Guilty To DUI

A local judge will not be appearing in court on Friday morning as originally scheduled, after his attorney entered a not guilty plea on his behalf.

Robert Messham Jr. is a Municipal Court Judge in Miamisburg and has served there for more than 21 years.

On Thursday, an attorney entered a written plea of not guilty on behalf of his client.Miami Township police said he was arrested after crashing his car into another vehicle

The other driver was Steven Storms. Storms said the judge appeared to be intoxicated. "He couldn’t even talk to me. He was mumbling. I said, 'sir do you know what you did?' He mumbled and said he drove to fast. The alcohol about knocked me back.”

Police said Storms was sitting at the intersection of Medlar and Benner roads when he saw an SUV headed right for him. Storms said he called 911, and within minutes, more than six police cruisers flooded the area.

“The detectives open up his door, get ahold of him and help him wobble across and put him in the car and then take off,” said Storms.

Deputy Chief John DiPietro, from Miami Township Police Department, said, “It is very difficult for us in the police department when we have an arrest of a colleague that we have work with for well over 20 years.”

DiPietro said Messham was arrested and charged with DUI.

The judge is listed on a city Web site as a sponsor of Miamisburg Dare Program, and in 2002 he spoke out against drinking and driving.
