NEW DETAILS: Court to pay for Miamisburg murder suspect’s DNA expert

A judge has ruled the court will pay at least $2,500 for an indigent Miamisburg murder suspect’s DNA expert.

Funding for the expert for Chaz Gillilan was approved by Montgomery County Common Pleas Court Judge Richard Skelton in the Dec. 30, 2018, killing of 18-year-old Miamisburg High School graduate Noah Kinser, court records show.

Skelton directs the court “to spend an initial $2,500.00 to retain an expert witness in the field of DNA analysis and testing to review the DNA evidence in this matter and that these expenses be taxed as costs in this case for the reason that the defendant is indigent and the services are necessary for defense counsel to effectively prepare for trial.

“This authorization specifically does not include the cost of testimony at trial, and the defendant shall seek additional funding from this court should testimony at trial become necessary,” court records state.

Gillilan, 31, of Coshocton County, is among three defendants charged with murder in the fatal shooting of Kinser.

Those three defendants – combined - face more than 60 counts, according to the indictments.

Authorities said they tied Gillilan to the shooting with DNA evidence. His trial had been set for April 13, but is now scheduled for May 4, according to court records.

Skelton’s ruling came after a request by defense attorney Marshall G. Lachman, who said his defendant is indigent.

Gillilan faces 20 charges, including six murder counts, four felonious assault charges, four robbery, two aggravated burglary and other counts, court records show.

Also facing murder charges in Kinser’s death is Jason B. Churchill, 32, of Moraine, and Daniel Matthew Simone, 29, of Englewood.

A fourth defendant, Dante English, 38, of Cincinnati, was indicted on arson, tampering with evidence, possession of criminal tools and insurance fraud in connection to the case.

Not guilty pleas have been entered for all four defendants.

Simone’s trial is also set for May 4, and Churchill’s case has been continued until March 23, court records show. The trial date for English is May 18.

Kinser was fatally shot in his Miamisburg apartment on North First Street, about a block from the police department, in what was the city’s first homicide since 2011, police said.
