EARLIER: Local men indicted for murder of Miamisburg High senior
Records indicate an assault rifle and “several handguns” were found in the vicinity of the North First Street apartment, but until this week police had not said if any of those weapons were in Kinser’s possession.
“The victim did fire in an attempt to defend himself,” Miamisburg Detective Sgt. Jeff Muncy said.
While declining to provide many details about the actions involved in the shootout, Muncy said the 9mm shells found with a defendant’s DNA on it did not come from the gun Kinser fired.

Jason B. Churchill, 32 of Moraine, Daniel M. Simone, 28 of Englewood, and Chaz Gillilan, 30 of Coshocton County, all face multiple charges – including murder – in Kinser’s death. Not guilty pleas have been entered for all three and they are each being held on a $1 million bond.
A fourth defendant, Dante English, 38 of Cincinnati, is facing lesser charges. He is being held on a $25,000 bond after not guilty pleas were entered for him today on charges of arson, tampering with evidence and two lesser offenses.
