Many officers may testify against Dayton suspect shot by Miami Twp. police at busy interchange

Public safety forces from several jurisdictions may testify against a Dayton teen facing several felony charges – including assaulting a police officer - involving a Miamisburg robbery after which the defendant was wounded.

The 18-year-old Dunbar High School student was 17 when the crime occurred Feb. 5 near a busy Ohio 725/Interstate 75 interchange. Adult charges are being sought against him for a what a judge called potentially deadly actions.

Multiple safety forces responded to the scene before the suspect was shot by an off-duty Miami Twp. police officer after the teen aimed a gun at the officer while seeking to flee by carjacking vehicles after a robbery at a Byers Road Sunoco, court records show.

Police from Jackson Twp., Miami Twp. and Miamisburg – as well as personnel from the Miami Valley Fire District – are named as potential witnesses in the case, according to court records filed last week.

The defendant is scheduled for a court date Friday.

He is charged with seven counts of aggravated robbery, one count of felonious assault on a police officer, discharge of a firearm on or over a public roadway, and impersonating a peace officer.

The off-duty officer who shot the suspect – James Swearingen – was cleared by a grand jury, which said he acted lawfully.
