"The applied-for mark is a commonplace term, message, or expression widely used by a variety of sources that merely conveys an ordinary, familiar, well-recognized concept or sentiment message," the USPTO wrote.
Sports Illustrated reported that James' company submitted the paperwork to trademark the phrase on Aug. 15. James is frequently seen shouting the phrase in videos he posts on social media. His family, teammate Anthony Davis and rapper 2 Chainz have all appeared in Taco Tuesday clips.
James wanted to trademark the phrase for "advertising and marketing services provided by means of indirect methods of marketing communications, namely social media, search engine marketing, inquiry marketing, internet marketing, mobile marketing, blogging and other forms of passive, sharable or viral communications channels," according to the application paperwork, SI.com reported.
The rejection means that James and others can keep using the phrase online and elsewhere without facing legal action.
