McEvoy was uncooperative with investigators and had to be forcibly taken into custody, police said. Police said he had numerous stolen items from a nearby car and from the drug store in his possession.
He was arrested and charged with endangering the welfare of a child, resisting arrest and two counts of criminal possession of stolen property, WGRZ reported. He was later released.
The child was returned to his mother. The incident is being investigated by the NYS Office of Child and Family Services.
